TDIU for Veteran with Lung Cancer Connected to Agent Orange Exposure

Veteran was service connected for lung cancer due to Agent Orange exposure.  Although the Veteran did not meet the criteria of 3.16(a), Quatrini Law Group was able to prove that the Veteran qualified for extra-scheduler consideration under 3.16(b).

The Board of Veterans Appeals granted entitlement to individual unemployability on an extra-scheduler basis because Veteran was unable to secure or maintain a substantial gainful occupation as a result of service-connected shortness of breath with exertion residuals of lung cancer s/p LUL lobectomy with pulmonary nodules, hepatic steatosis to include hepatic cysts and liver lesions.
