Understanding Social Security Disability Benefits

The Social Security Administration pays disability benefits under two programs. Social Security Disability (SSD) are benefits paid to disabled workers and their families. SSD benefits are determined by the work you’ve done and the money you’ve paid into the Social Security system. Your SSD benefits are calculated from your earnings.

Supplemental Security Income (SSI) are benefits paid to a disabled individual who qualifies financially due to a lack of resources and income and who has no significant work history.

Who May Qualify for Social Security Disability in Pennsylvania

If you have had the misfortune of suffering a disabling physical or emotional illness or injury and are unable to work, you may be eligible for SSD benefits. If you are disabled but do not have enough quarters of work to apply for SSD, you may be eligible for SSI. There are also SSI benefits for disabled children. A free evaluation by our office will help you to decide if filing a claim is right for you.

Physical Conditions That May Qualify

Some of the more common physical disabilities we see are back pain and surgery, carpal tunnel syndrome, Fibromyalgia, Multiple Sclerosis, HIV-related disability, shoulder conditions, heart disease, and Lupus.

Mental Health Conditions That May Qualify

Some of the more common mental health disabilities we see are bipolar disorder, manic depression, anxiety, ADHD, ADD in adults, and Post-Traumatic Stress Disorder (PTSD).

The Social Security Disability Process in Pennsylvania

The Social Security process can be a long road. You start with an application and an initial decision. Up to 70% of applicants will be denied. If denied, you can appeal and have a hearing in front of a Social Security judge. Quatrini Law Group will help you to make sure everything is done correctly and increase your chances of receiving benefits.

Common Reasons Social Security Disability Claims Are Denied

Many first-time applicants for SSD and SSI are denied, often due to insufficient medical documentation, incomplete applications, or income eligibility issues. An experienced Social Security Disability lawyer can help strengthen your case. Quatrini Law Group can assure your application is thoroughly documented, and that no significant disabling condition is overlooked. This is also important at the appeal level, should your initial application be denied.

Frequently Asked Questions About Social Security Disability

How long does it take to get approved for SSD?

It usually takes 3-6 months from the date of filing your application to get an initial decision. The majority of people who apply for SSD benefits are denied benefits at this initial level. The denial notice will explain that you have 60 days to appeal the decision. It then takes 22-24 months to get in front of a Social Security Judge. So, it can be a very long process.

What happens if my SSD claim is denied?

You have the right to appeal the decision. As stated above, it can be a two year process to appeal and have your hearing.

Can I receive SSD and workers’ compensation at the same time?

Yes. In Pennsylvania, if you’re receiving Workers’ Compensation benefits, it may seem that filing for Social Security Disability benefits is unnecessary. Nothing could be further from the truth. For someone who may not work for at least a year, there are significant reasons to consider filing for Social Security Disability benefits, even before workers’ compensation benefits end.
