Dealing with Insurance Agencies after an Auto Accident

Welcome to Legal Tip Tuesday here at Quatrini Rafferty.
I’m Jeff Monzo, one of the personal injury attorneys at the firm.
And I’m Dick Galloway, also one of the personal injury lawyers at Quatrini Rafferty.
What we wanted to talk to you about today was the situations where you have been in an auto accident and, almost immediately, you’re being contacted by your insurance company and the other driver’s insurance company. And in that situation, Dick, what do our clients do?
Well, you have two different duties. First of all, to the other insurance company (the other driver’s insurance company) you have no duty, and it is not in your best interest to talk to them. You should simply tell them you don’t want to talk about the accident. For your own insurance company, you have a duty of cooperation; your policy requires you to work with your insurance company, so you want to talk to them about what happened and what your injuries are. I would suggest to you that you keep it short and to the point rather than going on and on and on with more and more detail. Keep it short and to the point, but cooperate with your company. If you do that, you’ve done everything that’s required, and you haven’t put yourself at a disadvantage by talking to the other insurance company when it’s still too early.
