In this Legal Tip Tuesday, Attorney Casey Seaman explains employee protections under the Pennsylvania Medical Marijuana Act. The law prevents employers from discriminating against individuals solely because they are certified to use medical marijuana, provided certain conditions are met.
Hi, my name is attorney Casey Seaman and this is another legal tip Tuesday. Today I’m going to talk about the Pennsylvania Medical Marijuana Act. Pennsylvania has protections in place for individuals who are certified to use medical marijuana. The Pennsylvania Medical Marijuana Act states that an employer cannot discriminate against an employee solely on their basis as an individual certified to use medical marijuana. To be an individual certified to use medical marijuana, you must possess a valid medical marijuana card in the state of Pennsylvania. This card cannot be expired prior to testing, and the employer must be on notice of your status prior to taking the drug test.
