Legal Tip Tuesday: New Protections for Pennsylvania Hunting Clubs

Hello and welcome back to Legal Tip Tuesday. Vince Quatrini from Quatrini Law Group along with my partner and hunter Ron Fonner. Ron, you have had a hunting camp up north for a long time.

Yes. My uh parents actually bought the property in 1962. We built the cabin in ’75. So uh my family’s had the property longer than I’ve been alive.

Yeah. That’s up in Tionesta. So Ron’s been a lifelong hunter. The Supreme Court of Pennsylvania just gave you the hunter and your hunting club more rights. Tell us about that, Ron.

So for a long time, over 100 years, the rule in Pennsylvania has been that if it’s open property, the game commission could come on your property without a search warrant. That was the same under the federal laws as under the Pennsylvania Constitution. That’s changed uh since July 21st, 2026. The Supreme Court said that the Game Commission cannot just come on your property without a search warrant. So that means you, the Hunting Club, anywhere in Pennsylvania, can protect yourself from unreasonable searches.

What do I have to do to get that protection, Ron?

So, in order to get that protection, you need to show the public that your land is private. No trespassing signs, the purple paint that you see on the trees, fencing, it doesn’t all need to be fenced, but if

you put a fence over a portion of it, it shows that you intend your property to be private. Gates on entrance roads, things like that.

Okay, so the takeaway, get a hold of your solicitor for your hunting club and find out about this Pennsylvania Supreme Court decision to protect your property rights.
